Please read these Terms & Conditions carefully. By accessing the Protocol Health website, requesting an appointment, or receiving services, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. About Protocol Health and these Terms

This website, protocolhealthmd.com, and the non-clinical services offered through it are provided by Protocol Health Support Services LLC (“Protocol Health,” “we,” “us,” or “our”), a management services organization located at 700 White Plains Road, #30, Scarsdale, NY 10583. These Terms & Conditions (“Terms”) govern your use of the website and our administrative services.

Additional terms, consent forms, and policies may apply to specific services, appointments, products, testing, or memberships. Where they conflict with these Terms for a given service, the service-specific terms control for that service.

2. Protocol Health is a management services organization — not a medical practice

Protocol Health Support Services LLC provides administrative, technology, scheduling, marketing, facility, and other non-clinical business-support services. Protocol Health does not practice medicine, does not employ the treating clinicians in their clinical capacity, and does not control clinical decision-making.

This structure allows a licensed medical practice to remain independently responsible for all clinical care, consistent with applicable laws governing the corporate practice of medicine.

3. Your medical provider; no provider relationship with Protocol Health

Clinical care is provided by Dentico Medical Services, PLLC, a physician-owned professional practice, together with other independent, licensed medical practices, clinicians, and provider networks that Protocol Health may work with from time to time (collectively, the “Providers”). Your physician–patient (or clinician–patient) relationship is with the Providers, not with Protocol Health.

Using this website or contacting Protocol Health does not by itself create a treatment relationship. A treatment relationship is established only after appropriate intake, identity verification, informed consent, clinical evaluation, and provider acceptance.

4. In-person and telehealth care

Protocol Health supports a brick-and-mortar clinic in Scarsdale, New York where the Providers deliver in-person care, and, where clinically appropriate and permitted by law, telehealth visits for eligible patients. The care model, availability, and eligibility for in-person versus telehealth services are determined by the Providers and by the states in which they are licensed.

Telehealth services are subject to a separate telehealth informed consent, which you will be asked to review and acknowledge as part of care.

5. We are not a pharmacy

Protocol Health is not a pharmacy and does not dispense medications. If a Provider prescribes medication, it is filled by an independent, licensed pharmacy, which may include compounding or mail-order pharmacies. Your relationship for dispensed medications is with that pharmacy, and the pharmacy’s terms, pricing, and policies apply.

6. We are not a laboratory

Protocol Health is not a clinical laboratory. Laboratory testing and diagnostics are performed by independent, licensed laboratories and diagnostic providers selected by you and your Provider. Those laboratories are responsible for their testing, results, and applicable terms and pricing.

7. Educational content is not medical advice

Information on this website — including articles, service descriptions, and general wellness content — is provided for general educational purposes only and is not medical advice, a diagnosis, or a treatment recommendation. It does not create a provider relationship and should not be relied upon in place of care from a licensed clinician.

Always seek the advice of your physician or qualified health provider with questions about a medical condition, and never disregard or delay seeking care because of something you read on this website.

8. Medical emergencies

Do not use this website or any Protocol Health communication channel for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

9. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use this website and request services. Services are available only where the Providers are appropriately licensed and where services may lawfully be offered.

10. Appointments, scheduling, and communications

Submitting a form, completing the intake questionnaire, requesting an appointment, or contacting us does not guarantee availability, eligibility, or acceptance for treatment. The care team may request additional information before scheduling or recommending services, and the Providers may decline to offer services where not clinically appropriate.

By providing your contact information, you consent to receive appointment, administrative, and service-related communications by phone, email, and text, and, where you opt in, marketing communications. Message and data rates may apply, and you can opt out of marketing at any time.

11. Prescriptions and medications

Any decision to prescribe is made solely by a licensed Provider based on a clinical evaluation, and only where medically appropriate. Prescriptions are not guaranteed and may require current lab work, follow-up, or an in-person visit. Prescriptions are filled by independent pharmacies as described above.

12. Laboratory testing and diagnostics

Where recommended, laboratory panels, imaging, and diagnostic testing are ordered by a Provider and performed by independent laboratories or diagnostic providers. Certain services may require baseline or follow-up testing before or during treatment for your safety.

13. Payments, pricing, and billing

Fees for consultations, memberships, treatments, products, testing, and other services are described at the time of purchase or scheduling and may change. Payments are processed through third-party payment processors, and their terms apply to the payment transaction. You are responsible for all charges you authorize.

Some services are offered on a self-pay basis and may not be billed to or covered by insurance. Where a service or lab is billed to insurance, coverage, copays, and deductibles depend on your plan, and you remain responsible for amounts your plan does not cover.

14. Cancellations, no-shows, and refunds

Appointment cancellation, rescheduling, no-show, and refund policies may apply and will be described in connection with the applicable service. Certain fees, memberships, testing, and products may be non-refundable once services have begun or items have been ordered or shipped.

15. Recurring services and memberships

If you enroll in a membership or recurring service, you authorize recurring charges to your payment method according to the plan terms until you cancel in accordance with those terms. Cancellation instructions will be provided with the applicable plan.

16. Accounts and accurate information

You agree to provide accurate, current, and complete information during intake and to keep it updated. Providing inaccurate information may affect your eligibility, safety, and the care that can be provided. You are responsible for maintaining the confidentiality of any account credentials.

17. Acceptable use

You agree to use the website lawfully and not to interfere with its operation or security, attempt to access it in an unauthorized way, misuse content, or use it to harass, defraud, or harm others. We may suspend or terminate access for conduct that violates these Terms or applicable law.

18. Intellectual property

The website and its content — including text, design, graphics, logos, images, and trademarks — are owned by or licensed to Protocol Health and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the content without our prior written permission.

19. Third-party services and links

The website may reference or link to third-party services, including provider networks, pharmacies, laboratories, payment processors, and scheduling tools. We are not responsible for the content, products, privacy practices, or actions of third parties, and your use of their services is governed by their terms.

20. No guarantee of results

Individual results vary. Nothing on this website or in our communications is a promise or guarantee of any particular outcome, result, or benefit. Treatment suitability and expectations are determined by your Provider based on your individual evaluation.

21. Disclaimer of warranties

The website and non-clinical services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

22. Limitation of liability

To the fullest extent permitted by law, Protocol Health Support Services LLC and its owners, members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of, or inability to use, the website or non-clinical services, or your reliance on general website information. This limitation does not apply to the extent prohibited by law and does not limit the responsibility of the Providers for the care they deliver.

23. Indemnification

You agree to indemnify and hold harmless Protocol Health Support Services LLC and its owners, members, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, violation of these Terms, or violation of applicable law or the rights of others.

24. Governing law and dispute resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Before initiating a formal dispute, you agree to first contact us so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York, unless a separate signed agreement provides otherwise.

25. Changes, severability, and entire agreement

We may update these Terms from time to time; material changes are reflected by updating the “Last updated” date above, and continued use means you accept the updated Terms. If any provision is found unenforceable, the remaining provisions stay in effect. These Terms, together with any service-specific terms and consents, are the entire agreement between you and Protocol Health regarding the website and our non-clinical services.
